THESE DATA TERMS OF USE (the “Terms”) are between The Solution, Inc., a business consulting and financial services company (“Company,” “we,” “us,” or “our”), and the User(s) of this website (“Users,” “you”). You must comply with these Terms as a condition of using our data and services. If you do not agree, we do not grant you a license to use the Data.

These Terms form a legal agreement (“Agreement”) between you, individually and/or as an agent on behalf of an entity, and The Solution, Inc., governing your use of our data, platform, and services.

The “Data” includes, but is not limited to: all text, financial models, underwriting criteria, application data, outputs, software, designs, images, content, and any other information made available by The Solution, Inc. in any format. All Data is owned exclusively by The Solution, Inc..

By accessing or using the Data, you acknowledge that you have read, understood, and agree to be bound by this Agreement and all applicable laws and regulations.

We reserve the right to update these Terms at any time. Continued use of the Data constitutes acceptance of any updated Terms.

LICENSE TO USE DATA

The Solution, Inc. grants you a limited, revocable, non-exclusive, non-transferable, non-assignable, and non-sublicensable license to access and use the Data strictly for lawful, non-competing purposes.

This license remains valid only while you are in compliance with these Terms and may be terminated immediately upon violation.

You agree that:

• The Data may not be copied, distributed, sold, or published

• The Data may not be used to compete with The Solution, Inc. or its affiliates

• The Data is used solely for evaluating, obtaining, or facilitating services offered by The Solution, Inc.

COMPLIANCE WITH LAW

You agree to use the Data in full compliance with all applicable federal, state, and local laws, including but not limited to:

• Equal Credit Opportunity Act (ECOA)

• Truth in Lending Act (TILA)

• Fair Debt Collection Practices Act (FDCPA)

• Federal Trade Commission Act (FTC Act)

• Texas state privacy and lending laws

• Applicable licensing and regulatory requirements

Any unlawful use is strictly prohibited.

GENERAL RESTRICTIONS

You agree NOT to:

• Modify, alter, or reverse engineer the Data

• Use the Data to expose non-public personal information

• Use the Data to harass, defame, or harm others

• Use the Data to solicit or broker financial services outside of The Solution, Inc. without written consent

• Use the Data for any competing financial or consulting services

PROPRIETARY RIGHTS

All rights, title, and interest in the Data—including intellectual property rights—remain the exclusive property of The Solution, Inc.

Unauthorized use may violate copyright, trademark, and other laws.

TRADEMARKS

“The Solution, Inc.” and all associated branding, logos, and marks are proprietary trademarks of the Company.

No license or right to use any marks is granted without prior written consent.

ATTRIBUTION

If referencing our Data in any third-party application or website, you must include:

“This service is not endorsed by, owned by, or affiliated with The Solution, Inc.”

FEES

Access to certain Data or services may be free or paid.

The Solution, Inc. reserves the right to introduce or modify fees at any time.

DISCLAIMER OF WARRANTIES

All Data is provided “as-is” and “as available.”

We make no guarantees regarding:

• Accuracy

• Completeness

• Reliability

• Timeliness

Your use of the Data is at your own risk.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless The Solution, Inc., its affiliates, officers, employees, and partners from any claims, damages, liabilities, or expenses arising from:

• Your misuse of the Data

• Your violation of these Terms

• Any misrepresentation made by you

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

The Solution, Inc. shall not be liable for:

• Lost profits

• Business interruption

• Indirect, incidental, or consequential damages

Total liability shall not exceed any fees paid by you to the Company.

ARBITRATION

Resolution of Disputes

Any dispute (“Claim”) shall be resolved through binding arbitration, administered by:

• American Arbitration Association (AAA), or

• JAMS

Arbitration will be conducted on an individual basis only—no class actions permitted.

SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force.

GENERAL PROVISIONS

This Agreement:

• Is binding upon you and your successors

• May not be modified except in writing by the Company

• Reserves all rights not expressly granted
